Terms of Service

These Terms of Service (“Terms”) govern your use of absolutebullion.com (the “Site”) and any purchase you make through it. The Site is owned and operated by Absolute Bullion (“we,” “us,” or “our”).

By using the Site or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

1. Eligibility

You must be at least 18 years old and able to enter into a legally binding contract to use the Site or purchase from us. By placing an order, you represent that you meet these requirements.

2. Accounts

You may be able to create an account to place orders, save addresses, and view order history. You are responsible for keeping your account credentials confidential and for all activity that occurs under your account. Notify us promptly if you believe your account has been accessed without your permission.

3. Product Information and Pricing

We strive to display accurate product descriptions, images, weights, and prices. However, errors may occur. We reserve the right to correct any errors at any time, including after an order has been placed.

Precious metals prices on our Site update in real time against live market spot prices. The price you pay is the price displayed at the time you complete checkout, subject to our right to cancel an order if a clear pricing error has occurred (such as a product displayed at a fraction of market value due to a system error).

4. Order Acceptance and Refusal

Your placement of an order is an offer to purchase. Our acceptance of your offer occurs when we charge your payment method and confirm your order. Before that point, no contract exists.

We reserve the right to refuse, cancel, or limit any order for any lawful reason, including but not limited to:

Pricing or product errors
Suspected fraud or unauthorized use of payment methods
Inability to verify the billing or shipping information you provided
Orders that exceed quantity limits we may set
Customers who have previously violated these Terms

If we cancel an order before charging your payment method, no charge is applied. If we cancel after charging, we will refund the amount charged.

5. Payment

You authorize us to charge the payment method you provide for the full amount of your order, including any applicable taxes and shipping. If a payment is declined, reversed, or charged back, we may suspend or cancel your order and may pursue any amounts owed by all lawful means.

6. Taxes

Sales tax is calculated and charged based on the destination of your order and applicable state law. For California residents, certain bullion products may qualify for sales tax exemption under California Revenue and Taxation Code Section 6355 (sales of monetized bullion, nonmonetized gold or silver bullion, and numismatic coins where the total transaction exceeds the statutory threshold). The Site applies tax automatically based on current rules; we do not provide individual tax advice.

7. Shipping and Returns

Shipping and returns are governed by our Shipping Policy and Returns Policy, each of which is incorporated into these Terms by reference.

8. Intellectual Property

All content on the Site — including text, images, logos, designs, software, and product descriptions — is the property of Absolute Bullion or its licensors and is protected by U.S. and international copyright, trademark, and other intellectual property laws. You may not copy, reproduce, distribute, modify, or create derivative works from any content on the Site without our prior written permission, except as expressly permitted by law.

9. User Conduct

You agree not to:

Use the Site for any unlawful purpose
Submit false or misleading information
Attempt to interfere with the Site’s operation or security
Use any automated system (bots, scrapers, etc.) to access the Site without our written permission
Attempt to access accounts, data, or systems that are not your own
Harass, abuse, or threaten our staff

We may suspend or terminate your access to the Site if you violate these Terms.

10. Disclaimers

The Site and all products are provided “as is” and “as available,” without warranties of any kind, except those that cannot be excluded under applicable law. We do not warrant that the Site will be uninterrupted or error-free, or that any product will meet a particular purpose beyond what is expressly stated.

Precious metals are speculative investments whose value can rise and fall. We do not provide investment, tax, or legal advice. Any educational content on the Site, including blog articles, market commentary, or buying guides, is for general informational purposes only and is not a recommendation to buy or sell any specific product. You are responsible for your own financial and investment decisions.

11. Limitation of Liability

To the maximum extent permitted by law, Absolute Bullion and its officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages — including lost profits, lost data, or lost goodwill — arising out of or related to your use of the Site or any product purchased from us.

Our total liability for any claim arising from or related to these Terms or any product is limited to the amount you actually paid for the specific product giving rise to the claim.

12. Indemnification

You agree to indemnify, defend, and hold harmless Absolute Bullion and its officers, directors, employees, and agents from any claim, loss, or expense (including reasonable attorneys’ fees) arising from your violation of these Terms, your misuse of the Site, or your violation of any law or the rights of any third party.

13. Governing Law

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws principles. You agree that any dispute arising from these Terms or your use of the Site will be brought exclusively in the state or federal courts located in Stanislaus County, California, and you consent to the personal jurisdiction of those courts.

14. Dispute Resolution

Before filing any legal action, you agree to first contact us at support@absolutebullion.com to attempt to resolve the dispute informally. If we cannot resolve it within 30 days, either party may proceed to court.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

16. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the “Effective” date at the top. Your continued use of the Site after changes are posted means you accept the revised Terms.

17. Entire Agreement

These Terms, together with our Privacy Policy, Shipping Policy, and Returns Policy, are the complete agreement between you and Absolute Bullion regarding your use of the Site and supersede any prior agreement.
